1. Agreement to Terms

By accessing our website and using Nightale, you agree to be bound by these Terms and Conditions and agree that you are responsible for the agreement with any applicable local laws. If you disagree with any of these terms, you are prohibited from accessing this site.

2. Use License

Permission is granted to temporarily view and use Nightale for personal, non-commercial purposes. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy our website materials or code;
  • use the materials for any commercial purpose (unless generated stories specify commercial rights ownership depending on your tier);
  • attempt to decompile or reverse engineer any software contained on Nightale's website;
  • remove any copyright or other proprietary notations from the materials; or
  • transfer the materials to another person or "mirror" the materials on any other server.

3. Content Generation & Responsibility

Nightale uses artificial intelligence to generate stories based on inputs provided by you. While we strive to ensure generated content is consistently appropriate, magical, and suited for children, you acknowledge that AI can occasionally produce unexpected results. You are solely responsible for reviewing the generated stories before reading them to your children.

4. Subscriptions & Payments

We offer premium subscription options for enhanced features, such as unlimited stories or additional languages. By selecting a subscription plan (Family or Annual), you agree to pay the fees indicated. Payments are handled securely via Stripe. You can cancel your subscription at any time, but we do not offer refunds for partial billing periods.

5. Disclaimer

The materials on Nightale's website are provided on an 'as is' basis. Nightale makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

6. Limitations

In no event shall Nightale or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Nightale's website, even if Nightale or a Nightale authorized representative has been notified orally or in writing of the possibility of such damage.
